Terms of Service

Welcome to Pofano, an AI API gateway service (the "Service"). The Service is operated by the person or organization that publishes and maintains the Pofano website ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms are effective immediately upon publication.

1. Account Registration and Security#

You must register an account to access the Service. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate and complete information. We reserve the right to suspend or terminate accounts that violate these Terms.

2. Service Usage#

The Service provides access to AI models and APIs through a unified gateway. You may use the Service only for lawful purposes and in compliance with these Terms and applicable laws.

3. Third-Party AI Providers#

The Service forwards requests to upstream AI model providers (such as OpenAI, Anthropic, Google, and others). We do not control the availability, quality, or output of these third-party services. You must also comply with the applicable terms, acceptable use policies, and data policies of the relevant upstream providers. You acknowledge that:

  • Upstream provider availability may change without notice.
  • Content generated by AI models may contain errors, biases, or inappropriate material.
  • You are responsible for reviewing AI-generated outputs before use.
  • You must not submit sensitive, confidential, or legally protected information through the Service unless you have verified the data handling policies of the relevant upstream provider.
  • You must not use unauthorized API keys, accounts, quotas, payment instruments, or other third-party resources.

4. Prohibited Conduct#

You agree not to:

  • Use the Service for illegal activities, fraud, or harassment.
  • Generate or distribute content that violates intellectual property rights.
  • Attempt to bypass rate limits, security measures, or authentication.
  • Reverse engineer, scrape, or interfere with the Service.
  • Use the Service to develop competing products without authorization.
  • Abuse payment, redemption, referral, promotional, or upstream provider systems.

5. Billing, Credits, and Payment#

Credits and Balance. The Service operates on a credit-based system. Usage consumes credits according to the pricing displayed on our platform.

Plans and Subscriptions. The Service may provide one-time plans, time-limited plans, or recurring subscription plans, depending on what is displayed at checkout or in the platform. Plan benefits, quota, duration, renewal, and cancellation rules are shown in the relevant product page or checkout flow.

Redemption Codes. Redemption codes are subject to their stated terms and may be revoked if obtained fraudulently or used in violation of these Terms.

Invitation Rewards. Invitation rewards are promotional and may be modified or discontinued at our discretion.

Compliance Lock. Certain billing features (redemption codes, subscription plans, invitation rewards) may be locked until the administrator confirms compliance terms in the payment gateway settings.

Payments. Payments may be processed by third-party payment providers. Payment providers may process payment information according to their own terms and privacy policies. Taxes, currency conversion, failed payments, chargebacks, and payment disputes may also be handled by the relevant payment provider.

Refunds and Disputes. Refunds, reversals, and payment disputes are handled according to applicable law, the relevant payment provider rules, and the actual status of your order and service usage. Please contact us if you believe a payment was made in error or a service was not delivered as expected.

6. Content and Data#

You retain ownership of content you submit to the Service. You grant us a limited license to process your content solely for the purpose of providing the Service. You are solely responsible for the legality, accuracy, and appropriateness of your content.

7. Service Availability and Changes#

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. We are not liable for downtime caused by upstream providers.

8. Disclaimer of Warranties#

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

9. Limitation of Liability#

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Governing Law and Dispute Resolution#

These Terms are governed by the applicable laws of the place where the Service operator is established or primarily operates, unless mandatory consumer protection laws provide otherwise. You agree to attempt informal resolution before initiating formal proceedings.

11. Changes to These Terms#

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes constitutes acceptance.
